CHARM MY EVENT
CLIENT GALLERY TERMS OF SERVICE
Effective Date: September 4, 2026
These Client Gallery Terms of Service (“Gallery Terms”) apply to access and use of online galleries, photographs, video, downloads, favorites, selections, digital media, and related online services provided by CHARM MY EVENT (“CHARM MY EVENT,” “we,” “us,” or “our”).
By accessing or using a CHARM MY EVENT client gallery, you acknowledge and agree to these Gallery Terms.
If the contracting client has a separately signed service agreement with CHARM MY EVENT, that signed agreement remains controlling regarding the services covered by it. If these Gallery Terms conflict with the signed client agreement, the signed agreement will control to the extent of the conflict.
1. PURPOSE OF THE CLIENT GALLERY
A CHARM MY EVENT client gallery is provided as a convenient method for:
• private media viewing;
• photo preview;
• video playback;
• digital delivery;
• downloading;
• favorites and selections;
• client communication;
• purchasing optional products; and
• related client services.
A client gallery is not intended to constitute permanent archival storage, disaster recovery, or the client’s sole backup of delivered media.
2. PRIVATE GALLERY ACCESS
A gallery may be protected through a private link, password, download PIN, client-specific credential, or other access control.
The contracting client is responsible for deciding who may receive gallery credentials.
Anyone who receives valid credentials may be able to view, download, favorite, share, or purchase content depending on the permissions enabled for the gallery.
CHARM MY EVENT is not responsible for access resulting from credentials voluntarily shared, forwarded, posted, published, or otherwise disclosed by the client or another authorized recipient.
If gallery access information is believed to be compromised, please contact CHARM MY EVENT promptly.
3. PROFESSIONAL THIRD-PARTY TECHNOLOGY
CHARM MY EVENT may use professional third-party providers for:
• gallery hosting;
• website hosting;
• cloud infrastructure;
• media storage;
• content delivery;
• networking;
• security;
• email;
• payments;
• printing;
• manufacturing;
• fulfillment;
• shipping;
• analytics; and
• related operational services.
Photographs, video, and related gallery data may therefore be uploaded to, hosted on, transmitted through, displayed by, processed by, streamed through, resized by, or stored using professional third-party infrastructure.
4. TECHNICAL PROCESSING OF MEDIA
To operate gallery and delivery services, CHARM MY EVENT may authorize professional technology providers to perform technical actions reasonably necessary to provide those services, including:
• hosting;
• transmitting;
• displaying;
• caching;
• resizing;
• encoding;
• streaming;
• processing;
• reproducing;
• securing; and
• delivering media.
Such technical processing does not itself transfer ownership of the underlying copyright to the technology provider.
5. SERVICE-PROVIDER CHANGES
CHARM MY EVENT may change or replace a hosting, gallery, cloud, payment, storage, production, fulfillment, or other professional provider when reasonably necessary for technical, operational, security, availability, quality, or business reasons.
Use or replacement of a particular provider does not alter the client’s underlying contractual rights.
If one gallery or delivery platform becomes unavailable or impractical, CHARM MY EVENT may use another commercially reasonable platform, download service, cloud service, transfer method, or delivery method.
6. DIGITAL DELIVERY
Where photographs, video, or other media are included in a signed service agreement, CHARM MY EVENT will provide the applicable media or reasonable access to it in accordance with that agreement.
The online gallery is one method of delivery and does not necessarily constitute the only permissible delivery method.
A technical outage or provider change does not by itself eliminate the client’s contractual rights to media otherwise required to be delivered.
7. CLIENT BACKUP RESPONSIBILITY
Clients are strongly encouraged to download final delivered media promptly and maintain independent backup copies.
Recommended backup locations may include:
• a personal computer;
• external storage;
• a separate cloud service; or
• another reliable independent location.
Once contracted final media has been reasonably made available for download or otherwise delivered in accordance with the applicable service agreement, the client is responsible for maintaining independent copies of the delivered files.
8. STANDARD GALLERY AVAILABILITY
Unless another period is stated in writing, CHARM MY EVENT may provide standard online gallery access for thirty (30) days following official gallery delivery.
After the stated expiration date, a gallery may become hidden, unavailable, removed, or later deleted.
Gallery expiration does not affect copies previously downloaded by the client.
9. EXTENDED ONLINE GALLERY ACCESS
Where offered, Extended Online Gallery Access may be purchased as follows:
Six (6) additional months: $99
Twelve (12) additional months: $169
If an extension is purchased before the current expiration date, the purchased term will be added to the existing expiration date.
If a gallery has already expired, reactivation may be available for a $29 reactivation/administration fee plus the selected extension term.
Reactivation is subject to the applicable files still being reasonably available.
Extended Online Gallery Access provides continued online access. It is not permanent storage, archival preservation, guaranteed backup, disaster recovery, data-recovery service, or a guarantee against all forms of electronic data loss.
Extensions do not automatically renew unless expressly agreed otherwise in writing.
If CHARM MY EVENT accepts payment specifically for an extension or reactivation but is unable to provide the purchased access because the gallery cannot reasonably be restored, CHARM MY EVENT will provide an appropriate refund for the unavailable extension/reactivation or another reasonable remedy.
10. DATA RETENTION, FILE AVAILABILITY, AND BACKUPS
CHARM MY EVENT and its professional providers use commercially reasonable measures intended to maintain reliable gallery and media-delivery services.
Electronic files and online systems may nevertheless be affected by circumstances including:
• hardware failure;
• software failure;
• file corruption;
• cybersecurity incidents;
• account changes;
• subscription changes;
• provider outages;
• service discontinuation;
• storage limitations;
• accidental deletion;
• network failure;
• natural disasters; or
• other circumstances within or outside CHARM MY EVENT’s reasonable control.
CHARM MY EVENT does not guarantee that an online gallery, photograph, video, or other digital file will remain hosted, stored, recoverable, or available indefinitely.
Expiration, cancellation, non-renewal, downgrade, suspension, or termination of a hosting or technology service may affect continued online availability.
Clients should therefore maintain independent copies of all final delivered media.
11. TECHNICAL FAILURES OR DATA LOSS
If gallery data or media becomes unavailable because of a technical failure, hosting-provider issue, service interruption, data corruption, account or subscription issue, or other event, CHARM MY EVENT will make commercially reasonable efforts, where reasonably possible, to:
• restore available data from existing copies;
• re-establish access;
• provide a replacement copy; or
• provide applicable contracted media through another reasonable delivery method.
CHARM MY EVENT does not guarantee successful recovery of files that are no longer reasonably available from CHARM MY EVENT or applicable providers.
Nothing in this section eliminates an obligation expressly stated in a signed client agreement or liability that cannot legally be limited.
12. DOWNLOADS
Where gallery downloads are enabled, clients should use the supplied downloadable files rather than relying on screenshots.
Large galleries may be divided into multiple download packages because of technical limits.
Download format, resolution, or method may vary depending on the applicable service configuration, media type, or client agreement.
Nothing in this provision reduces a contractual obligation to provide a resolution expressly promised in a signed agreement.
13. VIDEO AND DEVICE COMPATIBILITY
Different computers, televisions, phones, tablets, browsers, applications, codecs, and operating systems may display or play media differently.
CHARM MY EVENT cannot guarantee compatibility with every present or future third-party device, application, browser, television, operating system, or software version.
If an original delivered file itself is confirmed to be corrupted, CHARM MY EVENT will make commercially reasonable efforts to provide a corrected copy where reasonably available.
14. PERSONAL USE OF DELIVERED MEDIA
Unless a signed client agreement provides otherwise, final delivered photographs and video may be downloaded, stored, displayed, printed, and shared by the contracting client for ordinary personal and family use.
Delivery of a digital file does not by itself transfer copyright or other intellectual-property ownership.
Copyright and other intellectual-property rights remain with CHARM MY EVENT and/or the applicable rights holder except where rights have been expressly transferred in a signed writing.
CHARM MY EVENT grants only rights that it owns or is authorized to grant.
Nothing in these Gallery Terms reduces any broader rights expressly granted in a signed client agreement.
15. COMMERCIAL USE
Unless separately authorized in writing by the applicable rights holder, delivered media may not be:
• sold;
• sublicensed;
• commercially licensed;
• used to manufacture merchandise for resale;
• used in paid commercial advertising;
• falsely represented as another creator’s work; or
• otherwise commercially exploited beyond the rights granted to the client.
16. SOCIAL MEDIA AND PERSONAL SHARING
Ordinary personal and family sharing is permitted unless restricted by a signed agreement.
For best quality, clients should use supplied download files rather than screenshots.
CHARM MY EVENT is not responsible for quality degradation caused after delivery by:
• screenshots;
• social-media compression;
• messaging applications;
• third-party printing;
• filters;
• artificial-intelligence editing;
• re-editing;
• color changes;
• re-encoding;
• cropping; or
• other modifications made outside CHARM MY EVENT’s reasonable control.
17. CLIENT-INITIATED ALTERATIONS
Reasonable personal cropping or resizing is permitted for ordinary personal use unless otherwise stated.
Substantial filters, artificial-intelligence manipulation, face or body modification, heavy retouching, compositing, or other significant changes can materially alter the original work.
CHARM MY EVENT is not responsible for the quality or appearance of media altered after delivery by another person, application, printer, service, or platform.
18. THIRD-PARTY PERSONAL PRINTING
If a client chooses to print downloaded files using a printing provider not selected or controlled by CHARM MY EVENT, CHARM MY EVENT does not guarantee that provider’s:
• crop;
• color;
• brightness;
• materials;
• quality;
• production;
• shipping; or
• customer service.
19. FAVORITES, SELECTIONS, AND CLIENT INSTRUCTIONS
Where gallery functions allow favorites, album selections, comments, notes, or other client input, CHARM MY EVENT may reasonably rely on selections or instructions submitted through the gallery or another authorized communication channel.
The client is responsible for reviewing and confirming selections before design or production is finalized.
20. CLIENT-SUPPLIED INFORMATION
The client is responsible for providing accurate contact information and other information reasonably necessary to provide the service.
CHARM MY EVENT is not responsible for delays or missed communications caused by:
• incorrect client-provided information;
• spam filtering;
• full mailboxes;
• blocked communications; or
• systems outside CHARM MY EVENT’s reasonable control.
21. PRIVACY
Gallery use is also subject to the CHARM MY EVENT Privacy Policy.
Information and media may be processed by professional service providers as reasonably necessary for hosting, delivery, payments, printing, fulfillment, shipping, security, and support.
22. SECURITY
CHARM MY EVENT uses commercially reasonable safeguards appropriate to the services within its reasonable control.
No internet service, online gallery, cloud platform, electronic-storage service, communications network, or payment service can be guaranteed completely secure.
Clients should promptly notify CHARM MY EVENT if gallery credentials are believed to be compromised.
23. FORCE MAJEURE AND EVENTS OUTSIDE REASONABLE CONTROL
CHARM MY EVENT will not be considered in breach solely because of delay or temporary inability to perform caused by circumstances reasonably outside our control, including:
• severe weather;
• natural disasters;
• fire;
• utility failure;
• widespread internet or telecommunications outage;
• cybersecurity incident;
• transportation disruption;
• labor disruption;
• governmental action;
• widespread infrastructure failure; or
• significant failure of an independent professional provider.
CHARM MY EVENT will make commercially reasonable efforts to resume performance or provide an appropriate alternative where reasonably possible.
24. LIMITATION RELATING TO ONLINE SERVICES
To the fullest extent permitted by applicable law, CHARM MY EVENT will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from:
• temporary interruption of an online gallery;
• an independent hosting or network outage;
• cloud-service interruption;
• voluntary sharing of gallery credentials;
• a client’s failure to download and independently back up delivered files after a reasonable opportunity to do so;
• use of third-party applications or printing services outside CHARM MY EVENT’s reasonable control; or
• another independent third-party technical failure.
Where a technology problem prevents delivery of media that CHARM MY EVENT is contractually required to provide, CHARM MY EVENT will make commercially reasonable efforts to restore access or provide the applicable media through another reasonable method.
Nothing in these Terms excludes liability that cannot legally be excluded.
25. CORRECTIONS
If a gallery contains a confirmed corrupted upload, incorrect file, access problem, or other technical error, please notify CHARM MY EVENT.
We will make commercially reasonable efforts to investigate and correct confirmed issues within our reasonable control.
26. LAWFUL USE
Gallery services may not be used for:
• unlawful activity;
• fraud;
• harassment;
• impersonation;
• unauthorized commercial exploitation;
• malicious distribution;
• infringement of another person’s rights;
• unauthorized access attempts; or
• interference with gallery security.
27. NO WAIVER
Failure by CHARM MY EVENT to enforce a provision on one occasion does not waive the right to enforce that provision later.
28. SEVERABILITY
If any provision of these Gallery Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
29. RELATIONSHIP TO SIGNED AGREEMENT
These Gallery Terms supplement but do not replace an applicable signed client service agreement.
Where a signed client agreement addresses a matter differently, that agreement will control to the extent of the conflict.
30. CHANGES
CHARM MY EVENT may update these Gallery Terms from time to time for future use and future transactions.
Terms will not be applied retroactively in a manner that eliminates rights already expressly granted under an existing signed agreement.
